Gift Card Terms
Orders Purchasing:
E-gift cards are available for sale on ShopDiva.ca and ShopDiva.com in $25.00, $30.00, $40.00, $50.00 and $100.00 CDN/USD denominations. Once you have purchased an e-gift card, we will send you an email that include your e-gift card code (a sixteen (16) character alphanumeric code). Ensure to keep your e-gift card code confidential and secure. By purchasing or using an e-gift card, you agree to be legally bound by these terms, the website’s terms of use (www.divacup.com/terms-of-service/) and Diva’s privacy policy (www.divacup.com/privacy-policy/).
Redeeming
You can only use your e-gift card code for online purchases on the same Diva website that you used to purchase the e-gift card. For example, if you purchased your e-gift card on ShopDiva.ca, your e-gift card code can only be used on ShopDiva.ca to make eligible purchases (as outlined in the “Restrictions” section below). If there is a balance after paying your order total, it remains associated with your e-gift card. If there is an amount owing once your e-gift card has been used, you must enter an additional payment method to complete the order.

Lost or stolen e-gift card codes
E-gift card codes cannot be recovered if lost or stolen.
If you purchased an e-gift card online and you have not received an email that includes your e-gift card code, check your junk mail or deleted items. If you still cannot find it, contact us with your name, your order number and email address and we will send you another email with an e-gift card code once we confirm the original has not been redeemed (which will result in the cancellation of the original e-gift card code). We are not responsible for the unauthorized redemption of an e-gift card.
Purchase Refunds
If you cancel or return an order that you completed using an e-gift card, Diva will return the funds via a new e-gift card. If such order was completed using an e-gift card and another method of payment, Diva will first return the funds via a new e-gift card, and any remaining balance will be returned using the other payment method that was used.
Supplier
E-gift cards are issued by Shopify Inc.
Restrictions
E-gift cards cannot be used to purchase e-gift cards. E-gift cards cannot be redeemed for cash (unless required by law) nor re-loaded, are not negotiable instruments, and cannot be replaced if lost or stolen. The risk of loss and title for e-gift cards passes to the purchaser upon our electronic transmission to the recipient. Without limiting the generality of the foregoing, Diva, its affiliates, agents, suppliers and service providers (collectively, the “Diva Group”) are not responsible for lost or stolen e-gift cards.
Diva reserves the right to hold an order for security review. If your order is affected, you will be notified via email. Diva reserves the right to close customer accounts, cancel orders and/or request alternative forms of payment if it deems an e-gift card was used in a fraudulent manner. Diva reserves the right to cancel an e-gift card associated with an unauthorized transaction at any time. Diva is not responsible for honouring e-gift cards purchased through unauthorized sellers.
Subject to complying with applicable law, Diva serves the right to amend these terms at any time and for any reason.
9. Limitation of Liability. (This Section does not apply to residents of Quebec.)
THE DIVA GROUP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO E-GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT AN E-GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND THE DIVA GROUP’S SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH E-GIFT CARD. THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
